Terms & Conditions

These Terms & Conditions ("Terms") govern access to and use of dMenu, a digital menu and QR table ordering platform for restaurants. By creating a dMenu account or using a restaurant's dMenu ordering page, you agree to these Terms.

1. Using dMenu

  • You must provide accurate information when creating a restaurant account and keep your login credentials confidential.
  • You are responsible for the accuracy of the menu, prices, and promotions you publish through your dashboard.
  • You must be legally permitted to operate a food business under the name and details you register with dMenu.

2. Subscriptions and billing

  • Access to dMenu is provided on the subscription plan and billing cycle selected at signup.
  • Subscription alerts and renewal reminders are sent to the restaurant owner ahead of renewal.
  • Failure to renew a subscription may result in the ordering page, kitchen display, or other features being temporarily suspended until payment is made.

3. Orders placed by customers

Orders placed through a restaurant's dMenu page are a direct transaction between the customer and that restaurant. dMenu provides the ordering, kitchen display, and WhatsApp notification technology, but is not a party to the sale of food or beverages and is not responsible for order fulfilment, food quality, pricing, or refunds — these remain the restaurant's responsibility.

4. WhatsApp communications

By providing a WhatsApp number to place or track an order, a customer consents to receive order confirmations, status updates, and verification codes from dMenu on behalf of the restaurant.

5. Acceptable use

You agree not to:

  • Use dMenu for any unlawful purpose or to sell illegal goods.
  • Attempt to disrupt, reverse engineer, or gain unauthorised access to the platform or other restaurants' data.
  • Upload menu content that is misleading, infringes on someone else's rights, or is otherwise unlawful.

6. Service availability

We aim to keep dMenu available at all times but do not guarantee uninterrupted access. Features such as printing, WhatsApp delivery, or QR generation depend in part on third-party services and your own hardware and internet connection.

7. Limitation of liability

To the fullest extent permitted by law, dMenu is not liable for any indirect, incidental, or consequential loss arising from use of the platform, including lost sales, missed orders, or delayed WhatsApp messages caused by third-party providers.

8. Termination

You may stop using dMenu at any time. We may suspend or terminate an account that breaches these Terms, misuses the platform, or fails to pay outstanding subscription fees.

9. Changes to these Terms

We may update these Terms from time to time. Continued use of dMenu after an update constitutes acceptance of the revised Terms.

10. Governing law

These Terms are governed by the laws of Sri Lanka, without regard to conflict of law principles.
